3. User Accounts

• You must be at least 13 years old to use the Service
• You are responsible for maintaining the confidentiality of your account credentials and API keys
• You agree to provide accurate and complete information when creating an account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Create campaigns for prohibited content (gambling, adult content, illegal substances, etc.)
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated systems to abuse the API (beyond reasonable rate limits)
• Share or expose your API keys to unauthorized parties
• Use the Service to create spam, fraudulent, or misleading advertisements

5. Campaign Content and Approval

• All campaigns are subject to review and approval by Verbena
• We reserve the right to reject, pause, or remove campaigns that violate our policies
• You are responsible for ensuring your landing pages comply with Google Ads policies
• Campaigns may be auto-approved if they meet certain criteria, or require manual review
• We are not responsible for Google Ads policy violations or campaign rejections by Google

6. Payment Terms

• Campaign funding is processed through Stripe
• Payments are required before campaign deployment to Google Ads
• All fees are non-refundable unless required by law or as otherwise stated
• We reserve the right to change our pricing with notice
• You are responsible for any taxes applicable to your use of the Service

7. API Usage

• API access is subject to rate limits as specified in your account settings
• API keys are provided on a per-account basis and must be kept secure
• You are responsible for all API usage under your account
• We reserve the right to suspend or revoke API access for abuse or policy violations
• API responses may include AI-generated content that should be reviewed before use

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Verbena and protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your campaign content, but grant Verbena a license to use it for providing the Service.

9. Third-Party Services

The Service integrates with third-party services including Google Ads and Stripe. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. AI-generated content is provided for assistance and should be reviewed before use.

11. Limitation of Liability

To the maximum extent permitted by law, Verbena shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Verbena from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.
